Effective Date: September 26, 2026
These Terms of Service (the “Terms”) are a binding agreement between you and Kipos (“Kipos,” “we,” “our,” or “us”) governing your use of the Kipos mobile application and related services (together, the “Services”).
Kipos is operated by Yazan Badran, an individual developer. You can reach us at any time:
Please read these Terms carefully. By downloading, accessing, or using the Services, you agree to them. If you do not agree, do not use the Services.
Sections Disclaimers, Limitation of Liability, and Governing Law and Disputes limit our liability and affect how disputes are resolved. Nothing in these Terms excludes rights you have under mandatory consumer law in your country — see Consumers below.
Our Privacy Policy explains how we handle your personal information and forms part of these Terms.
You must be old enough to form a binding contract where you live, and you must meet the minimum age in our Privacy Policy: 13 if you are in the United States, and 16 if you are in the European Economic Area (EEA), Switzerland, or the United Kingdom. If you are under the age of majority in your jurisdiction, you may use the Services only with the involvement of a parent or guardian who agrees to these Terms.
We do not ask for your date of birth and we do not verify your age, so meeting this requirement is your responsibility. If we learn that someone below the applicable age is using the Services, we will close the account and delete its data as described in our Privacy Policy.
You may not use the Services if you are barred from doing so under applicable law, or if we have previously terminated your account.
Anonymous use. When you first open Kipos we create an anonymous account for you automatically, so your garden can be saved before you sign in. Anonymous accounts are not recoverable: if you lose your device, uninstall the app, or clear its data before adding a sign-in method, that garden is gone.
We also delete unused anonymous accounts. If an anonymous account has been inactive for 30 days and holds no plants, no photos and no completed onboarding answers, we delete it and its data permanently. An account you are still using is never deleted this way, and adding an email address or signing in with Google or Apple removes it from this process entirely. Our Privacy Policy describes this in full.
Signing in. You can convert an anonymous account into a permanent one by setting an email address and a password — we send a one-time code to that address to confirm it — or by signing in with Google or Apple. Whichever you choose, your existing garden data is preserved and stays attached to the same account. The one exception is signing in with an email address, Google account or Apple account that already belongs to a Kipos account: we sign you in to that existing account, and anything added anonymously on this device before you signed in stays with the anonymous account rather than moving across.
Keeping your account secure. You are responsible for keeping your password confidential, for the security of the email account and any third-party accounts you use to sign in, and for all activity that occurs under your Kipos account. Choose a password you do not use anywhere else, and do not share it. If you forget it, you can set a new one using a code we email to your address — so access to that email account is what ultimately protects your Kipos account. If you sign in with Google or Apple and later revoke Kipos’s access from that provider, or lose access to that account, you may be unable to sign in — we recommend adding your email address as well. Tell us promptly at support@kipostracker.com if you believe your account has been compromised.
One account per person. Please do not create multiple accounts to circumvent usage limits, free-trial eligibility, or a suspension.
Deleting your account. You may delete your account and associated data at any time, as described in our Privacy Policy. Deletion is permanent, and your garden data cannot be recovered afterwards.
This section is important. Please read it in full.
The current version of Kipos is a record of the care you give your plants. It does not identify plants or give care advice. App versions 1.1.2 and earlier used artificial intelligence to identify plants from photographs, to generate care plans, and to score how well the plants in your garden suit one another. This section applies to anyone still using those features. They are provided for general informational and horticultural purposes only.
Identifications and guidance can be wrong. Plant identification from a photograph is inherently uncertain. Many plants closely resemble one another, and some safe plants have dangerous look-alikes. Kipos may misidentify a plant, express confidence in an incorrect result, or generate care information that is inaccurate, incomplete, or unsuitable for your specific plant, climate, or conditions.
Do not rely on Kipos for any decision affecting health or safety. In particular, you must not rely on the Services to decide whether any plant, fungus, seed, berry, leaf, or other material is:
Never eat, ingest, or medicinally use a plant based on a Kipos identification. Consult a qualified expert — a botanist, mycologist, horticulturist, physician, veterinarian, or poison-control centre — before acting on any information the Services provide. If you suspect poisoning, contact your local emergency services or poison-control centre immediately.
Not professional advice. The Services do not provide medical, veterinary, agricultural, or other professional advice, and no relationship of that kind is created by your use of them.
How the features work. Photos and plant details you submit for these features are sent through our servers to a third-party AI provider that processes them to return your result, as described in our Privacy Policy. Because these features cost us money to run, we apply fair-use limits to them; we may change those limits over time.
You remain responsible for your own gardening decisions and for complying with any law that applies to the plants you grow, move, or dispose of, including rules on protected, invasive, controlled, or quarantined species.
Kipos is a paid subscription app. After you set up your first plant, continuing to use the Services requires an active subscription or a running free trial. There is no permanently free tier.
Free trial. We may offer a free trial. Unless you cancel before the trial ends, the subscription begins automatically and the first charge is taken at the end of the trial. Trial eligibility is limited to one per person, and we may withdraw or change trial offers at any time.
Automatic renewal. Subscriptions renew automatically at the end of each billing period at the then-current price, until you cancel. You can cancel at any time, and cancellation takes effect at the end of the period you have already paid for.
How to cancel. Subscriptions are sold through the app store you downloaded Kipos from — currently the Apple App Store. You cancel in that store’s subscription settings; deleting the app does not cancel a subscription.
Prices and changes. Prices are shown in the app before you buy and may vary by country and over time. We will give you reasonable advance notice of any price change affecting your renewal, and you may cancel before it takes effect.
Payment. Payment is taken by that app store under its own terms, using the payment method on your app-store account. We never receive your payment details, and we cannot charge you directly. If a payment fails, the store may retry it, and we may suspend paid features until it succeeds.
Refunds. Except where required by law or expressly stated, payments are non-refundable and there are no refunds for partial billing periods. Because you purchase through an app store, refunds are requested from and handled by that store under its policies, not by us.
Consumers in the EEA and UK. You generally have a statutory right to withdraw from a distance contract within 14 days. Where you ask us to begin providing digital content or services immediately, you acknowledge that you may lose that withdrawal right once performance has begun, to the extent permitted by law. Your other statutory rights are unaffected.
You own your content. Plant names, notes, photographs, and other material you add to Kipos (“Your Content”) remain yours. We do not claim ownership of it.
Licence to us. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transmit, adapt, and display Your Content solely to operate, secure, and improve the Services for you — for example, to store your plant photos, return an identification, or render your garden in the app. This licence exists only so we can run the Services and ends when you delete the content or your account, except for copies retained in routine backups or as required by law.
We do not use Your Content to train AI models, and our AI provider is engaged to process it on our behalf rather than for its own training.
Your responsibility. You confirm that you have the rights necessary to submit Your Content and that it does not infringe anyone’s rights or break the law. Do not upload photographs of other people without their agreement.
Shared photos are public-read. As explained in our Privacy Policy, plant photo links are unguessable but not access-controlled: anyone with the specific link can view the image. Please do not put sensitive or identifying material in plant photos.
You agree not to:
We may investigate suspected misuse and take any action we reasonably consider appropriate, including removing content and suspending or terminating accounts.
The Services — including the app, its design, text, graphics, icons, and underlying software — are owned by us or our licensors and are protected by intellectual property law. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Services for your own non-commercial purposes, subject to these Terms. All rights not expressly granted are reserved. Kipos’s name and logo may not be used without our written permission.
Feedback. If you send us suggestions or feedback, we may use them without obligation or compensation to you.
The Services rely on third parties, including our hosting and authentication provider, our AI provider, the app store that sells and processes your subscription, our subscription-management provider, and the sign-in providers you choose to use. Your use of Google or Apple to sign in is also governed by that provider’s own terms and privacy policy. We are not responsible for third-party services, and their availability is outside our control.
The Services are not affiliated with, endorsed by, or sponsored by Google or Apple.
By you. You may stop using the Services at any time and delete your account.
By us. We may suspend or terminate your access, with notice where reasonably practicable, if you breach these Terms, if we reasonably suspect fraud or misuse, if required by law, or if we discontinue the Services. Where we discontinue a paid service you have already paid for, we will provide a pro-rata refund for the unused portion unless the termination results from your breach.
Effect. On termination, your licence to use the Services ends. Sections that by their nature should survive — including Your Content licences already granted for retained copies, disclaimers, limitation of liability, indemnification, and governing law — survive termination.
We are a small operation and provide the Services on a best-efforts basis. We do not promise that the Services will be uninterrupted, error-free, or permanently available, and we may modify, suspend, or discontinue any feature at any time. We will give reasonable notice of material adverse changes where we can.
To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.
We do not warrant that the Services will meet your requirements, that plant identifications or care guidance in older app versions will be accurate or complete, that your plants will thrive, or that any defect will be corrected.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost plants or crops, business interruption, or loss of goodwill, arising out of or relating to the Services, whether based in contract, tort, negligence, strict liability, or otherwise, and whether or not we were advised of the possibility.
Our total aggregate liability arising out of or relating to the Services will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) USD 50.
Nothing in these Terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that applicable law does not permit to be excluded.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
To the extent permitted by law, you agree to indemnify and hold harmless Kipos and its operator from any claims, damages, liabilities, and reasonable legal costs arising from your misuse of the Services, your breach of these Terms, or Your Content. This does not apply to consumers to the extent prohibited by applicable consumer law.
If you use the Services as a consumer, you keep the benefit of any mandatory rights under the consumer law of your country of residence, and nothing in these Terms limits or excludes those rights. Where these Terms conflict with a mandatory consumer protection, that protection prevails.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it, without regard to conflict-of-laws rules. The courts of the Province of Ontario will have jurisdiction over any dispute, and you and we consent to their jurisdiction.
If you are a consumer, this does not deprive you of the protection of the mandatory laws of your place of residence, and you may bring proceedings in your local courts. Consumers in Ontario keep their rights under the Consumer Protection Act, 2002, and consumers in Quebec keep their rights under the Consumer Protection Act (Quebec), including any right to bring proceedings in their own district.
Time limit for claims. Except where applicable law does not permit it, any claim arising out of or relating to the Services must be brought within one year of the events giving rise to it. This does not shorten any period that mandatory consumer law in your country of residence guarantees you.
Before starting formal proceedings, please contact us at support@kipostracker.com — most issues can be resolved informally, and we will try to do so within 30 days.
Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us regarding the Services.
Severability. If any provision is held unenforceable, the rest remains in effect and the unenforceable provision is modified to the minimum extent needed.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
Force majeure. We are not liable for failures caused by events beyond our reasonable control.
These Terms are between you and us only, not with Apple, and we alone are responsible for Kipos and its content. Apple has no obligation to provide maintenance or support for Kipos.
If Kipos fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price to you; to the maximum extent permitted by law Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
We, not Apple, are responsible for addressing any claim relating to Kipos, including product liability claims, any claim that Kipos fails to conform to a legal or regulatory requirement, consumer protection claims, and any third-party claim that Kipos infringes intellectual property rights.
You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
We may update these Terms from time to time. When we make material changes, we will update the Effective Date above and, where appropriate, give notice in the app. Changes are not retroactive. Your continued use of the Services after an update means you accept the revised Terms; if you do not agree, stop using the Services and delete your account.
